The United States Supreme Court has heard arguments in a significant case involving religious freedom and LGBTQ rights, following a legal challenge brought by Catholic schools in Colorado.
The case, St. Mary Catholic Parish v. Roy, centres on Colorado’s publicly funded preschool programme, which requires participating schools to provide equal access to children regardless of characteristics including sexual orientation and gender identity. Catholic schools argue that the requirement conflicts with their religious beliefs and their right to operate in accordance with Church teachings.
During the November 3 hearing, several conservative justices appeared receptive to the schools’ arguments, questioning whether the state could exclude religious institutions from public benefits because of their beliefs. However, other justices raised concerns about balancing religious freedom with equal treatment and non-discrimination protections.
The case could have significant implications for religious institutions seeking government funding while maintaining their religious identity and beliefs. A final ruling is expected by the end of the Supreme Court’s current term.
