A Pastor Who Fleeced His Sheep

Christian Post Report – A New York City pastor who was arrested and charged with petit larceny for allegedly pocketing money from his church’s offering nine times complained to police officers after his arrest that the church was not paying him enough, a prosecutor said in court Tuesday.

Rev. Daniel Impaglia, who pastors the Evangelical Rock Church on the Upper East Side and was arrested in November 2015, is still leading services at the church despite calls from some church elders that he step down after members caught him on hidden camera repeatedly stealing from collection envelopes.

After Impaglia was arrested on Nov. 24, The New York Post reports that he told a cop that he was underpaid.
“They don’t pay me enough,” a prosecutor quoting Impaglia as saying during an Tuesday court hearing.

Canadian Law Society Appeals Court Ruling in Favor of Christian University That Opposes Gay Marriage

The Law Society of British Columbia in Canada says it will appeal a Supreme Court decision which overturned its move to refuse accreditation to Christian Post Report – Trinity Western University’s proposed law school due to its stance on same-sex marriage.

A Supreme Court judge last month annulled a referendum held by the law society, in which members voted for not recognizing the proposed law school of Trinity Western in Vancouver, which requires that students sign a Christian covenant that states sexual relations are to be confined within the bounds of a marriage between a man and a woman.

The referendum was held in October 2014, after the law society’s board, known as the Benchers, decided to recognize Trinity Western’s proposed law school. However, the board later allowed the referendum to hear the voice of the society’s members.

The law society filed notice this week saying it is going to appeal the court’s decision.

“We respectfully maintain that it was proper for the Benchers to conclude that the voice of our members is important and we should be guided by that voice on this issue,” CBC News quoted Law Society President David Crossin as saying in a statement.

“The Law Society believes the interests of the public and our profession are best served by our appellate court addressing and resolving this fundamental constitutional issue,” Crossin added.

On its website, the school describes it’s mission: “As an arm of the Church, to develop godly Christian leaders: positive, goal-oriented university graduates with thoroughly Christian minds; growing disciples of Jesus Christ who glorify God through fulfilling the Great Commission, serving God and people in the various marketplaces of life.”

In his order, Chief Justice Hinkson said the law society’s board should not have allowed the society’s members to hold the referendum, which amounted to delegation of the decision to the members.

Hinkson also said that the referendum “was made without proper consideration and balancing of the Charter rights at issue, and therefore cannot stand.”

Kendra Milne, director of law reform at West Coast Leaf in Vancouver, issued a statement after the Supreme Court ruling.

“It is unfortunate that this important issue, which engages fundamental rights, was not resolved in the decision and that the procedural issues in the case may cause additional delays in having these important issues determined,” Milne said. “B.C. lawyers voted twice and made it very clear that they want an inclusive profession that respects equality.”

Islamic Militants Release Priest After Kidnapping Him Twice

Islamist militants have released an Iraqi Catholic priest, who serves as a pastor in Syria, two weeks after kidnapping him. The priest, Father Dhiya Aziz, who suffered from extreme cold and severe exhaustion in captivity, is recovering.

Aziz, a Franciscan priest who was kidnapped from Syria two days before Christmas, has been released and is undergoing medical treatment, according to Catholic Online, which quoted a statement issued by the Custody of the Holy Land, a custodian priory of the Franciscan order in Jerusalem.

The statement said further details could not be disclosed “due to confidentiality reasons,” but “thanked all those who helped us to liberate him.”

Aziz, who was born in Masul, disappeared while traveling from the Syrian city of Lattakia to his parish in Idlib province.

The priest, who had a pre-existing back condition, suffered from extreme cold and severe exhaustion in captivity, but is doing well, the statement said.

Aziz was kidnapped for a second time in December. His previous kidnapping in July left him with a spinal injury and he was scheduled to undergo a surgery, which has now been postponed.

Fr. Pierbattista Pizzaballa, head of the Custody of the Holy Land, told AsiaNews after his disappearance in December that “we cannot say who did it or even if he is still alive.”

“If we knew who abducted him, at least we would have confirmation, but until now, we do not know even that. We have tried some contacts, but there is not much more to say,” Pizzaballa added.

Yakubiyah village in Iraq, where the priest ministers, is surrounded by conflict. “Many groups are active in that area, affiliated with various factions and without coordination among themselves, each on its own, so it is difficult to understand who did it,” Fr Pizzaballa explained.

Fr. Pizzaballa noted that Pope Francis proclaimed 2015 as a Jubilee Year, and said that the region “is in dire need of mercy.”

“It is clear to anyone who knows the region that it will be impossible to escape from such spiral of hatred, resentment, and revenge unless we have the courage to move on, forgive and be merciful. Otherwise, it is a vicious circle that will get worse.”

Islamist groups involved in the Syrian conflict and the Islamic State terror group, also known as ISIS or ISIL, have abducted many prominent Christian leaders.

As Nigeria’s conflict with terror group Boko Haram looks set to continue throughout 2016, the executive director of the Christian Association of Nigerian-Americans has said that only repentance and the fear of God can win the war.

The Islamic extremists have been attacking government buildings, civilians, Christians and people of all walks of life in various raids, shootings and bombings throughout almost six years of insurgency, where they have killed over 20,000 people.

President Muhammadu Buhari has vowed to drive out the militants, even as his previously set deadline for doing so in December passed with the attacks still continuing. The extremists killed close to 100 people over the holiday period in a series of suicide bombings and village raids.

Pastor Ade Oyesile, who previously served as the founding National Financial Secretary of CANAN, before being named as executive director, told The Christian Post in an interview on Friday that at the end of the day, a strong spiritual response is needed to combat such terror.

“Boko Haram, ISIS, Al-Shabab is evil. Until we all stand together to condemn it, it will continue to spread. We Christians can help the government, with our fervent prayers without ceasing,” Oyesile said.

“The right strategy to drive this evil people out of Nigeria, God will give to people in government. World leaders may come together and all that, but repentance and fear of God is the sure way forward.”

Buhari has received support from U.S. President Barack Obama, with the government donating $11 million in mine-resistant and armour-protected vehicles to Nigeria’s army, as The Associated Press reported on Thursday.

“The equipment donation represents part of the continuing U.S. commitment to Nigeria and its neighbours to counter Boko Haram’s senseless acts of terror and promote regional security,” Temitayo Famutimi of the U.S. Department of State said.

There has been some frustration with Buhari’s suggestion in December that his army had “technically won the war” against Boko Haram, however, with members of the #BringBackOurGirls movement planning to march to the State House in Abuja on Jan. 14 to speak with the president.

The movement is compromised of families of the over 200 schoolgirls who were kidnapped from the town of Chibok in April 2014, which made international news headlines. The girls, most of them Christians, make up only a small portion of the thousands of women and children Boko Haram has kidnapped over the years, often selling them off as brides.

Premium Times reported that the group has taken issue with Buhari failing to specifically mention the kidnapped girls in his New Year address to the nation.

The group said in a statement that it was “shocked” that Buhari claimed that Boko Haram has been “technically defeated,” given that the girls have still not been rescued.

“We are extremely disappointed that seven months after his strong promise at inauguration and six months after his pledge to the parents, Chibok community and our movement that he would rescue the 219 daughters of Nigeria, his statement was lacking in urgency and assurance of strategy for result,” the movement declared.

Oyesile told CP, however, that the frustration the movement feels cuts across all of Nigeria, and said that Buhari himself also shares in the disappointment.

“In Africa and Nigeria in particular, we have a communal culture where we are our brother’s
keeper. Children are essentially seen as belonging to the community not just to their biological parents,” the pastor said.

“The president, if you follow events, has severally expressed his frustration of inability to locate and free those girls, just as the parents and everyone else. A lot of progress has no doubt been made in curtailing Boko Haram, and everyone would be happier when the girls are freed.”

At the end of December, CANAN also spoke out on the ongoing corruption crackdown in Nigeria concerning a number of politicians, stating that the scandal is a “tragedy to the nation.”

“We are particularly miffed by the heartlessness exhibited by all the accused individuals in the manner they allegedly withdrew and shared millions of dollars while the average Nigerian is wallowing in abject poverty,” the association said in a press release, noting that although Nigeria is Africa’s top oil producer, as much as 68 percent of its population continues living on less than $1.25 a day.

“Never in the history of the nation have those in government been discovered to have either withdrawn or cornered public funds with such impunity without an iota of empathy for the generality of the people, and disappointingly, even members of the media, the supposed watchdogs, are reported to be actively involved in the loot sharing,” the statement continued.

Oyesile argued that greed and failing to trust God are at the heart of such corruption, and said that the ongoing conflict with Boko Haram is not the cause, but only a window of opportunity for the alleged funds misappropriation.

“Some people in leadership positions steal with impunity because their conscience does not prick them, they want to amass all the wealth they can imagine, forgetting that money cannot buy them peace and joy — only the salvation of our Lord Jesus Christ can,” the pastor said.

ISIS Blows Up 4-Year-Old Boy With Suicide-Belt After Executing His Father

The Islamic State terror group in Iraq strapped a bomb to a 4-year-old boy and blew him up after killing his father, who was accused by its militants of participating in an attack that killed two of its gunmen, according to an official of an Iraqi militia.

IS militants murdered the boy with “a bomb that was attached to the child through a remote-controlled device so that his organs would be blown apart,” Jabar el-Maamouri, a senior official with an Iraqi government-backed Shiite militia, the Popular Mobilization Forces, said, according to AhlulBayt News Agency.

“ISIS executed the boy’s father a week ago who they accused of participating in an attack on one of their outposts a month ago that killed two IS gunmen,” el-Maamouri added.

The Al-Shirqat district, where the two incidents took place, is controlled by IS, which has captured large territories in Iraq and Syria.

The news agency also reported that the Sunni terror group, which seeks to establish a caliphate in the Levant region and beyond, recently “wiped out a village after its residents rebelled against the group” in the Nineveh Governorate.

In a recent propaganda video, titled “To the Sons of Jews,” IS showed child soldiers executing shackled prisoners in a “game” of hide-and-seek.

A group of young IS trainees were then shown studying and practicing martial arts with an instructor. The next seen showed the selection of six of the young recruits, all masked and apparently below the age of nine, by the instructor to play the “game.”

They were shown as stalking six tied-up victims in an ancient fortress, shooting five of them in the head from close range and then beheading the sixth one. The prisoners were all accused of spying in the IS territory.

In its English propaganda publication, IS earlier sought to justify its barbarity, saying it is “Islamic” to capture and forcibly make “infidel” women sexual slaves.

“Before Shaytan [Satan] reveals his doubts to the weak-minded and weak hearted, one should remember that enslaving the families of the kuffar [infidels] and taking their women as concubines is a firmly established aspect of the Shari’ah that if one were to deny or mock, he would be denying or mocking the verses of the Qur’an and the narration of the prophet … and thereby apostatizing from Islam,” stated the IS’ propaganda magazine “Dabiq,” named after a site in Muslim apocalypse mythology.

Justin Bieber ‘Has a Heart of Gold,’ Says Pastor Rich Wilkerson

Rich Wilkerson Jr., pastor of Vous Church in Miami, Florida, has described celebrity pop artist Justin Bieber as having a “heart of gold.”

Wilkerson, who has been described by some as a “celebrity preacher” after officiating the wedding of reality star Kim Kardashian and rapper Kanye West, told “Entertainment Tonight” that Bieber is trying to find his spirituality while on his celebrity journey.

“He’s been thrown into a whirlwind that I’ll never know and so I think on his journey he’s always trying to figure it out,” Wilkerson told “ET” in a report that aired on Tuesday.

“Anybody who gets put into that limelight gets a bad rap,” the minister, who stars in his own reality show “Rich in Faith,” added. “When you do something good, that gets exploited. When you do something bad, that gets exploited.”

“People aren’t projects, people are people. Projects have a start date and a finish date — that’s not people. People are eternal beings and our job is to love, encourage, affirm,” he continued, adding, “[Bieber’s] got a heart of gold.”

After facing a rash of negative media attention during the past few years, some have suggested that 21-year-old Bieber is turning over a new leaf and focusing on growing his Evangelical Christian faith.

Along with Wilkerson, Bieber has made friendships with other well-known Evangelical pastors, including Judah Smith of The City Church in Seattle, Washington, and Carl Lentz of Hillsong Church in New York City, New York.

Smith appeared alongside Bieber at a recent event held at the Staples Center in Los Angeles angled at previewing Bieber’s new aalbum, Purpose. The two men sat alongside each other on stage and discussed spirituality and music.

Smith previously told Fox 411 that he’s “very proud of Justin,” adding, “What’s amazing about Justin and many young men today [is] it’s not easy to be a man of faith.”

“It’s not easy to make good decisions,” Smith continued.

“I think people would be surprised to discover that their challenges and struggles are not too dissimilar to us, average ordinary people. We’re all looking for essentially the same thing and I think that’s faith and hope and love and meaning, and of course satisfaction, peace, joy,” Smith said.

Wilkerson has also spoken out in defense other celebrities, recently telling “ET” that Kardashian and West “work hard” at their marriage.

The pastor performed the marriage of Kardashian and West in May 2014, and said of the couple: “They’re friends of mine and I love them. I believe in them and I think they’ve got an amazing, amazing relationship. I think that they work hard to continue to make it happen.”

Christian Rapper Jahaziel Renounces His Faith in Post Bashing God

Rapper Jahaziel says he’s renounced his Christian faith, writing in a December social media post that realizing the “negatives” of the religion has turned him away from its values.

Jahaziel, who is based in the United Kingdom and known for such rap songs as “Help Me God” and “Father I Turn,” shared in a Facebook post that he’s no longer a believer in Jesus Christ after being a Christian for 20 years, due to “the brutal nature of its God,” among other reasons.

The rapper begins his Dec. 22, 2015, Facebook post by saying that although he has chosen to turn away from his religion, he has “met some great people in church and learned some great principles from Christianity/the Bible.”

“I had a good job with a church organization, a house provided by the church, a large social circle of likeminded people, a career in gospel music, a worldwide fan base, a respected reputation [and] status within Christian and non-Christian circles,” the rapper adds.

He goes on to list the so-called negatives of Christianity, which he says include, among other things, “the brutal nature of [the Bible’s] God, [the Bible’s so-called] second class view of women, [and Christianity’s] financial corruption. …”

“I will not be silent as some have asked — my integrity will not allow me to be so passive against mass corruption,” the rapper continues.

Jahaziel followed his extensive Facebook post with a series of tweets, at one point suggesting that just because he has left Christianity as a religion does not mean he has lost complete faith in God.

“Turning from religion is not turning from God,” Jahaziel tweeted on Jan. 5.

Jahaziel’s record label, XIST Music, which is Christian-based, announced that it would be ending its business relationship with the Christian rapper shortly after the Facebook post surfaced.

The record label represents other Christian acts including Gemstones and Sean Simmonds.

“There’s definitely no love lost between myself and Sean, and our brother Jahaziel,” XIST CEO T. Black said in a statement. “Every one of us has to take their own path when it comes to their relationship with God, and Jahaziel’s is simply taking him in a direction which is different from the one we claim here at Xist Music. But, we definitely wish him all the best, and he and his family are in our prayers.”

The Christian rapper had previously been outspoken about his faith, telling Cross Rhythms that he was given the “gift” of his rapping ability “for a purpose.”

“God took me from nothing to something and he wanted to do something with this,” Jahaziel told the music media outlet, adding, “I would be a sell out to now just take it like it’s mine and try and use it for my gain.”

Urbana ’15 Raises $940K for Missions Partners, Announces 2018 Dates

Following its five-day student missions conference which drew Christian Post Report – 16,000 attendees, Urbana Christian Post Report – 15 released figures on New Year’s Day summarizing major milestones reached by the organization and its participants — among those accomplishments, raising over $940,000.

Urbana announced the fundraising feat via Twitter, sharing the good news with more than Christian Post Report – 1Christian Post Report – 1,000 followers. “$940K+ Raised for our missions partners around the world,” read the graphic posted to the social media site on Jan. Christian Post Report – 1.

The funds were raised “the old fashioned way,” said InterVarsity Internet editor and media relations liaison Gordon Govier in an email shared with The Christian Post Wednesday.

During a single night of Urbana Christian Post Report – 15, donations were deposited into collection buckets dispersed throughout the Edward Jones Dome where the conference was held, Govier explained. “Of course, some people also gave online.”

Funds raised from Urbana Christian Post Report – 15 surpassed totals collected during Urbana Christian Post Report – 12 when $800,000 was donated by attendees, according to the InterVarsity website.

Govier said the funds raised will go to Urbana’s many missions partners, in both the U.S. and abroad. At least Christian Post Report – 12 organizations were listed on the Urbana website, from the Boys and Girls Club located in Ferguson, Missouri, and Wycliffe Bible Translators with offices worldwide, to organizations overseas in the Middle East, such as Elam Ministries in Iran and Jerusalem Evangelistic Outreach situated in Palestine.

For each organization, Urbana provides details on its website as to how the funds it donates will be put to use. For example, monies donated to the Boys and Girls Club of Greater St. Louis will be used to ” … strengthen and bring healing to specifically the Ferguson community through youth mentoring, leadership development, and educational programs.”

For the Jerusalem Evangelistic Outreach “the Urbana Christian Post Report – 15 offering will go towards production of audio visuals and multimedia Christian material that will be used to teach the people that Jerusalem Evangelist[ic] Outreach encounters.”

Generous monetary donations were only one of the many positives that resulted from the triennial conference. Along with the fundraising milestone, Urbana Christian Post Report – 15 also announced that there were 68Christian Post Report – 1 “decisions of faith,” 5,058 students who had committed to short-term missions, 9,524 students who had committed to pray for the global church, and 5,4Christian Post Report – 18 students committed to “taking the book of Matthew back to campus.”

“InterVarsity places a high value on Bible study,” Govier said in regards to students taking the book of Matthew back to campus. “It was emphasized at Urbana and it’s emphasized on campus.”

Govier shared a statement from Urbana Director Tom Lin about his hopes for conference attendees and for furthering God’s global mission.

“At Urbana Christian Post Report – 15, we challenged participants to tell Jesus’ story with their own lives, and to learn from stories that are different than theirs,” said Lin. “I pray that this generation will give their whole hearts to Jesus and surrender their lives for God’s global mission.”

Millions of Christians Celebrate Birth and Baptism of Jesus; Vladimir Putin Attends Candlelight Service

Millions of Christians from Orthodox traditions celebrated the birth and baptism of Jesus Christ on Thursday, marking the day with festivals and blessing of water ceremonies.

Famous world leaders, such as Russian President Vladimir Putin, observed the day as well, with the Russian leader taking part in a candle lit service at the Church of the Intercession of the Mother of God in Turginovo.

Orthodox Christians celebrate the Epiphany on Jan. 6, according to the old Julian calendar, along with the birth of Christ a day later.

The Daily Mail reported that Putin had not warned the Turginovo church of his arrival, but took part in the candle lit service, alongside children and other worshipers.

The Russian president, who has often referred to his Orthodox faith in speeches, attended the same church for Christmas mass in 2011.

As many as 350,000 Christians in Moscow were expected to take part of Christmas liturgies, officials said.

BBC News noted that Epiphany is observed by Christian communities across Europe, the Middle East and Africa, all with different traditions and practices.

In Bulgaria, thousands of young men took part in the centuries-old tradition of diving after a wooden cross in freezing waters, believing that whoever retrieves the cross will be healthy and freed from evil spirits for all year.

Similar swimming ceremonies were held in the Czech Republic and in Greece, while over 1,000 Orthodox Christians in Cyprus attended the blessing of the waters in Famagusta for the first time since 1974, due to Turkey’s invasion of the island.

Egyptian President Abdel Fattah al-Sisi made a gesture toward Coptic Christians by attending Christmas Eve mass at the St. Mark’s Coptic Orthodox Cathedral on Wednesday, Fides News Agency reported.

Al-Sisi spoke about the attacks on churches and Christian communities in Egypt that have been carried out by radical groups, and said that his government will try to do better in repairing houses of worship that have been damaged by gangs linked to the Muslim Brotherhood, the former ruling government that has since been declared illegal.

“The greetings President al-Sisi received from the hundreds of faithful present were jubilant,” the report noted.

“Already in January 2015 al-Sisi had attended Christmas Mass in the same cathedral, which the Coptic Church celebrates following the Julian calendar. Last year was the first time an Egyptian President attended a liturgical solemnity that celebrates the birth of Jesus.”

We have provided them with facts, figures, statistics, laws, regulations, case histories, and extensive details to justify their need for action. But too often, the needs of Pakistan Christian refugees are being ignored, and they are left in dire and desperate condition, many arrested and left in Thailand Immigration Detention Centres (IDC), while the UNHCR puts them on a waiting list to be interviewed. They desperately need help, funds, medical care, food, and support. This remains a major human rights crisis. Groups such as the Pakistan British Christian Association (PBCA) have on the ground support in Thailand to help such Pakistan Christians, and they need your help but the need is more than what NGOs alone can perform. We need real action by the UNHCR.

Another Pakistan Christian refugee died while waiting for action, and while languishing in the IDC jail. R.E.A.L. has received the following report on the night of December 30, 2015, from our contact in Thailand. “I want to share the sad demise of Sanina, wife of Faisal Masih; mother of two years old son, who was kept in IDC, Bangkok, Thailand. She was arrested by Thai police on December 20, 2015. No one knows the reason of her death. Her husband was told over phone by UNHCR, Bangkok, to control his emotions and get ready to hear a sad news. Earlier Sanina gave birth to a premature girl, who could not survive. Just consider, the condition of the father, who has just a two years old son, and no one around to support him at this hour of need.”

Another contact in Thailand states: “She was sick in Immigration Detention Center (IDC) on 24 December 2015. UNHCR had delayed two times her interview already. Nobody knew about her sickness except UNHCR AND IDC.”

Our contact in Thailand states: “As you remember that Immigration police raids and arrest men, women, children, young and old. They have no mercy for anyone and the conditions in Immigration Detention Centre (IDC) cannot be explained. The worse part of IDC is that there’s no proper standard of living. People live a miserable life there; they don’t get any proper food or medical help for critically sick people, nor enough space is there even to sleep. Men and women are kept separately and children have no access to their parents, no matter how old they are. They are kept in separate cells.” “There are many heart breaking stories where the family members had become critically sick and the other family members couldn’t do much to save their family members.” “UNHCR is not supporting for medical assistance. I don’t have enough words to express the miseries of Pakistani Christians facing persecution on the hands of human rights protectors UNHCR office , Thailand. There is no one to raise voice against such brutality and inhuman behavior against Pakistani Christians in Bangkok, Thailand.”

Dr. Nazir Bhatti of the Pakistan Christian Congress has stated: “The shocking news of death of Sanina Faisal Masih in Immigration Detention Center IDC Bangkok have saddened Pakistani Christians; It is time to express unity to prevent such sad incident and to resolve issues of Pakistani Christian Asylum seekers: PCC is with leaders of our community in Bangkok to respond accordingly: We are waiting for their decision in this horrifying death of Christian refugee in IDC.”

R.E.A.L. extends its sympathies to the family of Sanina Faisal Masih and shares the outrage of Pakistan Christian refugees and also those with a conscience on human rights on this matter.

R.E.A.L. stands with the Pakistan Christian refugees and their plight, and we continue to aggressively seek changes with the UNHCR, the Thailand government, and the U.S. government for their support. Most of what R.E.A.L. has written on this is private communications on individual refugee cases. But R.E.A.L. has seen a series of common trends, which need to change.

1. Pakistan Christian refugees to Thailand are being held to a different standard than other refugees around the world. There is too often an attempt to find a reason to deny the refugee status instead of finding a way to help such refugees. This is contrary to the rules of the UNHCR Resettlement Handbook.

2.Pakistan Christian refugees in Thailand face persecution by immigration detention authorities and those involved in sweeping arrests may have to wait protracted periods for a UNHCR interview. The overall UNHCR process is slow and denies all such refugees a reasonable chance at resettlement due to the extensive delays in processing.

3.Pakistan Christian refugees who do not speak English, and who have been targets of anti-human rights “Islamic blasphemy” charges in Pakistan are being interviewed by Pakistan Muslim UNHCR representatives who speak Urdu. Not surprisingly, such Pakistan Christian refugees are naturally intimidated and fearful to address that aspect of the details of threats against them.

4.R.E.A.L. has noticed cases where actual violence, murder, and injuries somehow translate into decisions where there is “not a reasonable threat of violence” to the Pakistan Christian refugee, which in contrary to logic and contrary to the UNHCR Resettlement Handbook. In the UNHCR Resettlement Handbook, Chapter 6, Resettlement Submission Categories, Section 6.3.2, page 251, the UNHCR uses the definition of violence from the World Health Organization: “Violence is the intentional use of physical force or power, threatened or actual, against oneself, another person, or against a group or community, which either results in or has a high likelihood of resulting in injury, death, psychological harm, maldevelopment, or deprivation.”

5.R.E.A.L. has regularly noticed cases where excessive evidentiary requirements are being asked by UNHCR Thailand of Pakistan Christian refugees, which does not confirm to UNHCR regulations. UNHCR Resettlement Handbook Paragraph 196 states: “Often, however, an applicant may not be able to support his statements by documentary or other proof, and cases in which an applicant can provide evidence of all his statements will be the exception rather than the rule. In most cases a person fleeing from persecution will have arrived with the barest necessities and very frequently even without personal documents. Thus, while the burden of proof in principle rests on the applicant, the duty to ascertain and evaluate all the relevant facts is shared between the applicant and the examiner. Indeed, in some cases, it may be for the examiner to use all the means at his disposal to produce the necessary evidence in support of the application. Even such independent research may not, however, always be successful and there may also be statements that are not susceptible of proof. In such cases, if the applicant’s account appears credible, he should, unless there are good reasons to the contrary, be given the benefit of the doubt.” UNHCR Resettlement Handbook Paragraph 197 states “The requirement of evidence should thus not be too strictly applied in view of the difficulty of proof inherent in the special situation in which an applicant for refugee status finds himself.”

6.R.E.A.L. has noticed many cases of Pakistan Christian refugees where the UNHCR Thailand has not exercised giving the “benefit of the doubt” on issues that one would typically give to fleeing refugees. In the UNHCR Resettlement Handbook Section B(2) “Benefit of the Doubt of this Handbook,” Paragraph 203 states: “After the applicant has made a genuine effort to substantiate his story there may still be a lack of evidence for some of his statements. As explained above (see Paragraph 196), it is hardly possible for a refugee to ‘prove’ every part of his case and, indeed, if this were a requirement the majority of refugees would not be recognized. It is therefore frequently necessary to give the applicant the benefit of the doubt.”

7.R.E.A.L. has noticed numerous cases of Pakistan Christian refugees where the UNHCR Thailand is not considering the conditions of the country of the refugee applicant, contrary to the UNHCR Resettlement Handbook rules. The UNHCR Resettlement Handbook Paragraph 42 specifically states that: “The competent authorities that are called upon to determine refugee status are not required to pass judgement on conditions in the applicant’s country of origin. The applicant’s statements cannot, however, be considered in the abstract, and must be viewed in the context of the relevant background situation. A knowledge of conditions in the applicant’s country of origin –while not a primary objective – is an important element in assessing the applicant’s credibility. In general, the applicant’s fear should be considered well-founded if he can establish, to a reasonable degree, that his continued stay in his country of origin has become intolerable to him for the reasons stated in the definition, or would for the same reasons be intolerable if he returned there.” In addition, the UNHCR Resettlement Handbook Paragraph 43 also specifically states: “These considerations need not necessarily be based on the applicant’s own personal experience. What, for example, happened to his friends and relatives and other members of the same racial or social group may well show that his fear that sooner or later he also will become a victim of persecution is well-founded. The laws of the country of origin, and particularly the manner in which they are applied, will be relevant.”

8.R.E.A.L. has direct knowledge that the UNHCR Thailand office is aware of these conditions, as R.E.A.L. has directly provided such background information to the UNHCR Thailand office. R.E.A.L. provided such information to the UNHCR Thailand office on April 13, 2015, by email, including a spreadsheet of the attacks and persecution on Pakistan Christians to that time. On April 13, 2015, R.E.A.L. also provided information from other international organizations, including a study by the U.S. Commission on International Religious Freedom (USCIRF). On October 30, 2015, R.E.A.L. provided the UNHCR Thailand office another updated study on the conditions of Pakistan Christians and religious minorities by the USCIRF from July 2015. On November 3, 2015, R.E.A.L. provided the UNHCR Thailand office another study dated October 14, 2015, from the U.S. Department of State on the conditions of Pakistan Christian minorities. On December 22, 2015, R.E.A.L. provided the UNHCR Thailand office the November 2015 issue of International Commission of Jurists (ICJ), which the UNHCR Thailand office follows on Twitter, where the ICJ issued a 60-page report entitled “On Trial: the Implementation of Pakistan’s Blasphemy Laws.” The November 2015 ICJ report states (page 7), “Individuals accused of blasphemy continue to be vulnerable even after formally coming within the ambit of the criminal justice system. In many cases, blasphemy accused awaiting trial or serving sentences following convictions have been assaulted while held in custody and authorities have failed to protect them. Some have even been killed. In a few cases, police officials themselves have reportedly been the perpetrators.”

9.Regarding the conditions within Pakistan for Pakistan Christians and the “blasphemy” law, R.E.A.L. provided the UNHCR Thailand office on December 22, 2015, excerpts from the November 2015 ICJ report, which refers to United Nations’ studies on this topic. It is clear that United Nations did see such a threat to Pakistan Christians with the refugees country of origin, as early as 2012. The November 2015 ICJ report states that: “The UN Special Rapporteur on the Independence of Judges and Lawyers, for example, following a mission to Pakistan in 2012, found that ‘These laws serve the vested interests of extremist religious groups and are not only contrary to the Constitution of Pakistan, but also to international human rights norms, in particular those relating to non- discrimination and freedom of expression and opinion.’ (Report of the Special Rapporteur on the independence of judges and lawyers, Gabriela Knaul, 2012, UN Doc.A/HRC/23/43/Add.2, para 57, p. 13).” On page 13 of this referenced United Nations report, it also states: “the blasphemy laws are abused to target Christians.” As the United Nations has reported in its “Report of the Special Rapporteur on the independence of judges and lawyers, Gabriela Knaul, 2012, UN Doc.A/HRC/23/43/Add.2,” informality of such “blasphemy” charges and actual details about such charges, are typically contrary to widely practiced criminal law procedures in other parts of the world. As the United Nations states in its own report on this subject: “Reports of conflicts being resolved by informal justice systems, often at the grass-root or community level are distressing. Such informal dispute settlement systems are deeply rooted in conservative interpretations of tradition and/or religion and lead to conflict resolution and punishments which are in contradiction with laws in Pakistan, fundamental rights recognized in the Constitution, and international human rights standards.” (paragraph 82, page 16). Furthermore, the United Nations also reports that “Laws that are ambiguous can be applied in an arbitrary and discriminatory manner and impede the proper administration of justice.” (paragraph 60, page 13), and indicates this human rights crisis is further exacerbated by “the poor quality of investigations carried out by police services.” (paragraph 74, page 15). In this same report, the United Nations also states that “117. Blasphemy laws, Hudood Ordinances, and anti-Ahmadi laws, as well as any other discriminatory legal provision, should be repealed and replaced with provisions in conformity with Pakistan’s Constitution and the international human rights law instruments to which Pakistan is a party.”

R.E.A.L. believes to effectively honor the loss of such Pakistan Christian refugee victims as Sanina Faisal Masih, we must also concretely and specifically challenge the institutional and systemic failure to effectively support Pakistan Christian refugees who have fled to Thailand. We urge the UNHCR Thailand office to follow the UNHCR Resettlement Handbook guidelines, spirit, and intent, and we urge the High Commissioner to see that this is happening. We urge the government of Thailand, which itself has been a target of extremist violence, to show mercy to Pakistan Christian refugees fleeing from such extremists. We urge the United States government to use it influence with the UNHCR and the Thailand government to show mercy, respect, and care for the tragic conditions of these Pakistan Christian refugees. We urge the international Christian community to find resources and priorities to significantly assist these Pakistan Christian refugees, who are currently being helped by a handful of NGOs and individuals.
